NOTICE OF RECEIVER'S SALE OF REAL ESTATE
By virtue of an Order of the Western Division Housing Court in City of Chicopee Health Department v. Heirs and Assigns of Beatrice Giguere and Rosario Giguere, Docket No. 16-CV-341, the Court has granted the Receiver, Witman Properties, Inc. authorization to sell the property located at 1640 Westover Road, Chicopee, Hampden County, Massachusetts to satisfy its priority lien pursuant to M.G.L. c. 111, §127I. The record owner of the premises is The Estate of Noella Beatrice Giguere.
The same will be sold at Public Auction at 2:00PM on November 29, 2017, on the premises located at 1640 Westover Road, Chicopee, Hampden County, Massachusetts which is bounded and described as follows:
The land in Chicopee, Hampden County, Massachusetts, together with buildings thereon, bounded and described as follows:
Beginning at a point on the Northerly side of New Granby Road, 230 feet westerly from an iron pin in the westerly line of land heretofore by Napoleon C. Boisvert et ux conveyed to Edward Bergeron, and running thence
Westerly along the northerly side of New Granby Road, 60 feet to land now or formerly of Napoleon C. Boisvert; thence running
Northerly at right angles to the northerly side of New Granby Road 120 feet to a point on other land now or formerly of said Napoleon C. Boisvert; thence running
Easterly in a line parallel with the northerly side of New Granby Road 60 feet to a point on other land now or formerly of said Napoleon C. Boisvert and thence running
Southerly in a straight line along other land now or formerly of said Napoleon C. Boisvert, 120 feet to the northerly side of New Granby Road and the point of beginning.
The premises above described are shown as Lot 3, marked Porter on a Plan entitled sub-division of land of Napoleon C. Boisvert, said plan being recorded with Hampden County Registry of Deeds, Book of Plans 34, Page 21.
Being the same premises conveyed to Rosario Giguere and Beatrice E. Giguere by deed of Thomas W. Dunnahoo and B. Theresa Dunnahoo, dated August 24, 1961 and recorded with Hampden County Registry of Deeds in Book 2829, Page 357. The premises will be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens, trash fee liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said receiver's lien, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.
TERMS OF SALE:
A deposit of $10,000.00 by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by certified or bank check at Lyon & Fitzpatrick, LLP, Whitney Place, 14 Bobala Road, 4th Floor, Holyoke, Massachusetts 01040 within 30 days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price. Other terms, if any, to be announced at the sale.
