RECEIVER’S SALE OF REAL ESTATE AT PUBLIC AUCTION PURSUANT TO MASSACHUSETTS GENERAL LAWS Chapter 111, Section 127I
By virtue of an Order of the Western Division Housing Court dated December 19, 2017 (Docket No. 15-CV-912) in favor of Joe Francis, Receiver, and against the Respondent, Jennifer Beattie, establishing a lien under Massachusetts General Laws Chapter 111, section. 127I, on the real estate known as 340 Grattan Street, Chicopee, MA 01013 for the purpose of satisfying said lien, the real estate will be sold at public auction at 11:00 A.M. on the 1st day of February, 2018 on the premises described in a deed dated June 7, 2012 and recorded with the Hampden County Registry of Deeds in Book 19293, Page 385, to wit: “the land in Chicopee, Hampden County, Massachusetts, with buildings thereon, bounded and described as follows: Beginning at an iron rod set in the ground on the Easterly side of Grattan Street, at the Northerly corner of the premises herein described; thence SOUTHEASTERLY: along the Easterly side of said Grattan Street, seventy-nine and 34/100 (79.34) feet to an iron rod; thence NORTHEASTERLY: thirty-five and 80/100 (35.80) feet to an iron pin; thence WESTERLY: at a right angle to last described line, one hundred twenty-eight and 80/100 (128.08) feet to the place of beginning. Subject to restrictions and reservations of record.” TERMS OF SALE: $5,000.00 Dollars is required to be paid in cash, certified check or bank cashier’s check as earnest money by the purchaser at the time and place of sale of the premises to be held by the Receiver, the balance to be paid in full in cash, certified check or bank cashier’s check within thirty (30) days thereafter at the offices of Peskin, Courchesne & Allen, P.C., 1391 Main Street, Suite 201, Springfield, Massachusetts 01103. The deed will be delivered contemporaneously therewith. The purchaser will be responsible for all outstanding taxes, municipal liens, closing costs, State documentary tax stamps, and all recording fees. The sale shall be subject to the approval of the Western Division Housing Court. The sale shall be subject to the receivership and the prospective new owner shall be subject to approval by the Court under the terms of the receivership order. The successful bidder at the sale shall be required to sign a Memorandum of Sale containing the above terms at the auction sale. Other terms to be announced at the time and place of the sale. The description for the premises contained in said deed shall control in the event of a typographical error in this publication.
